Q2.(a) ‘The administrative state is the creation of a power to bind us, with rules … that are not made by legislature.’ Discuss the constitutionality of the administrative state and its future. (20)
Answer : The administrative state is the establishment of a power to impose rules on us that Congress does not make. According to Montesquieu, the administrative state is founded on the consolidation of all three powers into a single executive agency. Congress establishes administrative agencies, grants them authority to issue regulations with legal force, enforce these regulations, and adjudicate violations in a manner that violates the Constitution. In a nutshell, the administrative state is built on a system of agencies that are run by public servants and are governed by administrative law. They all work within well-defined statutory constraints and are subject to extensive judicial review. The foundation of the rule of law is made up of all of these components.

ANSWER: According to the Hawthorne studies, people's work performance is influenced by their level of job satisfaction and social issues. According to the findings of the studies, intangible motivators, such as satisfying individuals' desire to belong to a group and be included in decision-making and work, are more important in boosting employee productivity than tangible motivators like monetary incentives and favorable working conditions. In the beginning, the studies investigated whether workers were more responsive and worked more efficiently under certain environmental conditions, such as improved lighting, and whether physical conditions affected productivity. The outcomes were unexpected: According to Mayo, workers were more responsive to social factors like their manager and coworkers than they were to factors like lighting, for example. The goal of the research was to find out. In point of fact, when the lights were turned back on, worker productivity increased, and absenteeism dropped and productivity at the factory reached its highest level since the experiment began.
